1. Agreement
These Terms of Service ("Terms") form a binding agreement between you and Eddytrip Trading Service Company Limited ("Eddytrip", "we", "us"). By creating an account, using our website, mobile applications, or any other Eddytrip service (the "Services"), you agree to these Terms.
2. Who can use the Services
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract. By using the Services you confirm you meet this requirement.
3. Account, identity verification, Trust Badge
To use most Services you must create an account and complete identity verification ("Trust Badge"). You agree the information you provide is accurate, current, and complete, and that you will keep it updated. You are responsible for all activity that occurs under your account and for keeping your credentials confidential.
4. What Eddytrip provides
Eddytrip is a platform connecting travellers with verified local partners and direct services across four categories: mobile data (eSIM), vehicle rentals, attraction tickets, and tours/experiences. For some categories Eddytrip acts as a reseller; for others Eddytrip is the intermediary between you and a verified local partner.
5. Bookings, fulfilment, and partner services
When you book through Eddytrip:
- For services fulfilled by a verified local partner, your contract for the service itself is with the partner. Eddytrip is responsible for the platform and for arranging the booking.
- For services Eddytrip provides directly (such as eSIM connectivity), your contract for the service is with Eddytrip.
- All bookings are subject to availability and confirmation.
- You agree to comply with reasonable instructions and conditions from partners (vehicle return windows, ticket validity periods, tour requirements).
6. Fees and payment
Prices shown in the app or on the website are inclusive of applicable platform fees unless stated otherwise. Payment terms, accepted methods, and processing are described in our Payment Policy.
7. Cancellations and refunds
Cancellation and refund eligibility depends on the service type, partner policy, and timing. See our Refund Policy for details.
8. Acceptable use
You agree to use the Services only for their intended purpose and lawful ends. See our Acceptable Use Policy for prohibited conduct, which includes (without limitation) fraud, abuse of partners, misuse of identity information, and any unlawful activity.
9. Intellectual property
Eddytrip, the Eddytrip name and logo, and all associated marks, designs, content, and software are the property of Eddytrip or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the Services as permitted by these Terms. You may not copy, modify, distribute, sell, or reverse-engineer the Services without our written permission.
10. User content
If you submit content (reviews, ratings, photos, feedback), you grant Eddytrip a worldwide, non-exclusive, royalty-free licence to use, display, and adapt that content for operating and promoting the Services. You confirm you have the rights to grant this licence. We may remove content that violates these Terms or any law.
11. Third-party services
The Services may include links to third-party services (payment processors, mapping providers, partner websites). Eddytrip is not responsible for the content, policies, or practices of third parties.
12. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available". We do not warrant that the Services will be uninterrupted, error-free, or completely secure. We do not guarantee the quality of partner-provided services beyond our verification and platform-management obligations.
13. Limitation of liability
To the maximum extent permitted by law, Eddytrip's total liability arising out of or in connection with the Services is limited to the amounts you paid to Eddytrip for the specific Service giving rise to the claim in the twelve (12) months preceding the claim. Eddytrip is not liable for indirect, incidental, consequential, special, or punitive damages.
Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
14. Indemnity
You agree to indemnify and hold Eddytrip harmless from claims, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
15. Termination
You may close your account at any time. Eddytrip may suspend or terminate your access for breach of these Terms, suspected fraud, abuse, or as required by law. Terms that by their nature should survive termination will do so (including sections 9–14 and 16–18).
16. Disputes and governing law
These Terms are governed by the laws of the Socialist Republic of Vietnam. Any dispute arising from or related to these Terms will be resolved through good-faith discussion first. If unresolved, disputes will be subject to the competent courts of Vietnam, except where consumer-protection law in your jurisdiction gives you the right to use local courts.
17. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the Services. Continued use after the effective date constitutes acceptance of the updated Terms.
